Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Freedom Forge AI LLC (“Freedom Forge AI,” “FFAI,” “we,” “us,” or “our”) concerning your access to and use of our websites, applications, platforms, products, utilities, software, artificial intelligence features, consulting and advisory services, educational programs, workshops, events, beta programs, waitlists, communications, and other offerings that reference or link to these Terms (collectively, the “Services”).

Freedom Forge AI LLC is a Connecticut limited liability company with a business and mailing address at 65 Queens Ave, Stratford, CT 06614-3523, United States.

By accessing or using a Service, creating an account, submitting a form, purchasing or subscribing to a Service, participating in a program, or otherwise indicating acceptance of these Terms, you agree to be bound by these Terms and all additional terms that apply to the applicable Service.

If you do not agree to these Terms, do not use the Services.

Certain Services may be governed by product-specific terms, order forms, statements of work, consulting agreements, educational agreements, school or institutional agreements, software licenses, subscription terms, beta terms, privacy notices, or other supplemental terms. If there is a conflict between these Terms and a written agreement signed by Freedom Forge AI and you or your organization, the signed agreement controls to the extent of the conflict.

1. Eligibility and Authority

You may use the Services only if you can lawfully enter into these Terms.

If you use a Service on behalf of a company, school, government entity, nonprofit, partnership, or other organization, you represent and warrant that you have authority to bind that organization to these Terms.

Certain Services may have age, geographic, professional, technical, or other eligibility requirements disclosed at the point of access or enrollment.

Freedom Forge AI may provide educational programs, workshops, curriculum, demonstrations, experiential learning opportunities, or other Services involving K-12 students. Services intended for minors may be subject to separate parental, guardian, school, district, or institutional permissions and safeguards.

General Freedom Forge AI commercial contact forms and general marketing Services are not intended to solicit personal information directly from children under 13.

2. Freedom Forge AI Services

Freedom Forge AI develops and provides a range of AI-enabled and technology-related offerings. Depending on availability, the Services may include:

• LifeHouse OS;
• The Internal Brain (TIB);
• AI-enabled platforms and utilities;
• business productivity and operational tools;
• Desktop Organizer;
• SEOlution and digital visibility-related tools or services;
• automation and workflow solutions;
• AI readiness and adoption services;
• strategic consulting and advisory services;
• fractional advisory services;
• implementation and integration support;
• workshops, courses, training, speaking engagements, and educational programs;
• beta, pilot, demonstration, and early-access programs;
• partner, investor, media, and business-development programs; and
• future Freedom Forge AI products, platforms, utilities, and services.

The availability, features, pricing, eligibility requirements, limitations, and functionality of any Service may change over time.

3. Supplemental Product and Service Terms

Some Services may include additional terms presented at purchase, enrollment, account creation, activation, or contracting.

Examples include:

• subscription or renewal terms;
• product-specific acceptable-use rules;
• statements of work;
• service-level terms;
• consulting engagement terms;
• beta-testing terms;
• educational program terms;
• school or district agreements;
• data-processing terms;
• refund or cancellation terms;
• product-specific privacy notices; and
• third-party license terms.

Those supplemental terms are incorporated into these Terms by reference for the applicable Service.

4. Accounts and Account Security

Some Services may require an account.

You agree to:

• provide accurate and reasonably complete registration information;
• maintain and update information as appropriate;
• keep passwords, credentials, authentication codes, and account access mechanisms confidential;
• use reasonable security practices;
• promptly notify Freedom Forge AI if you suspect unauthorized access or compromise; and
• accept responsibility for activity conducted through your account to the extent permitted by law.

You may not share credentials in a manner that defeats applicable license, seat, subscription, or security restrictions.

Freedom Forge AI may require additional authentication or security controls for certain Services.

5. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You may not use the Services to:

• violate applicable law or regulation;
• infringe intellectual property, privacy, publicity, contractual, confidentiality, or other rights;
• create, transmit, distribute, or facilitate unlawful, fraudulent, deceptive, defamatory, abusive, harassing, or malicious content;
• impersonate another person or organization;
• misrepresent your affiliation with a person or entity;
• introduce malware, malicious code, ransomware, spyware, or other harmful technology;
• probe, scan, test, or bypass security or authentication mechanisms without authorization;
• gain unauthorized access to accounts, systems, networks, or information;
• interfere with the integrity, security, availability, or performance of the Services;
• scrape, harvest, extract, or collect information in violation of law, technical controls, or applicable permissions;
• reverse engineer, decompile, disassemble, or attempt to derive source code except where such restrictions are prohibited by law;
• resell, sublicense, distribute, or commercially exploit a Service except as expressly authorized;
• use a Service to develop or train a competing system using Freedom Forge AI proprietary materials without written permission;
• use AI-generated output as the sole basis for decisions that legally require human review or professional judgment;
• use a Service to make unlawful discriminatory decisions;
• misrepresent AI-generated or AI-assisted content in a manner that is deceptive or unlawful;
• create deepfakes, synthetic media, or impersonations for fraudulent or harmful purposes;
• violate third-party platform terms while using a Freedom Forge AI integration; or
• encourage, enable, or assist another person to engage in prohibited conduct.

Freedom Forge AI may investigate suspected violations and may suspend or terminate access where reasonably necessary to protect users, systems, third parties, or the Services.

6. Artificial Intelligence Features

Certain Services use or interact with artificial intelligence, machine learning, automation, retrieval systems, language models, computer vision, recommendation systems, or other automated technologies.

6.1 AI Output May Be Inaccurate

AI-generated or AI-assisted output may be incomplete, inaccurate, outdated, misleading, biased, inappropriate, or unsuitable for a particular purpose.

You are responsible for reviewing output before relying on it.

Freedom Forge AI does not warrant that AI-generated output will be correct, unique, error-free, complete, or fit for a particular decision or use.

6.2 Human Review and Consequential Decisions

AI is intended to assist human judgment, not replace legally or professionally required human review.

You should not rely solely on AI-generated output for decisions involving matters such as:

• medical diagnosis or treatment;
• legal rights or obligations;
• tax preparation or tax positions;
• investment or financial decisions;
• credit, lending, or insurance decisions;
• employment, hiring, termination, promotion, or compensation;
• student discipline, admissions, grading, or other high-impact educational decisions;
• safety-critical decisions; or
• other consequential decisions requiring licensed, regulated, fiduciary, or professional judgment.

Where appropriate, consult a qualified professional.

6.3 No General-Purpose Model Training Without Express Authorization

Freedom Forge AI does not use identifiable customer or user content to train general-purpose AI models without express authorization.

Freedom Forge AI may use aggregated, anonymized, or appropriately de-identified information for legitimate analytics, security, debugging, performance measurement, research, and product improvement as described in our Privacy Policy and applicable supplemental notices.

6.4 Third-Party AI Providers

Some AI functionality may rely on third-party technology providers.

Your information may be processed by authorized providers when reasonably necessary to provide the applicable Service. Third-party systems may have their own technical limitations, availability conditions, and data practices.

Freedom Forge AI does not control every third-party model, platform, or infrastructure provider and does not guarantee uninterrupted availability of third-party technology.

7. Professional Services, Consulting, and Advisory Work

Freedom Forge AI may provide consulting, strategic advisory, implementation, education, transformation, readiness, automation, and related professional services.

Unless expressly stated in a signed written agreement:

• consulting is advisory in nature;
• recommendations are based on information reasonably available at the time;
• business conditions, laws, technology, vendors, and AI capabilities may change;
• the customer remains responsible for business decisions and implementation;
• Freedom Forge AI does not guarantee a particular financial, operational, regulatory, hiring, marketing, sales, investment, or other outcome; and
• professional services do not constitute legal, accounting, tax, medical, investment, insurance, or other regulated professional advice unless separately provided by a properly licensed professional acting in that capacity.

A statement of work, proposal, order form, or consulting agreement may establish additional deliverables, fees, assumptions, dependencies, timelines, ownership, confidentiality, and acceptance criteria.

8. Educational Services

Freedom Forge AI may provide workshops, training, curricula, demonstrations, courses, speaking programs, and educational experiences.

Educational Services are intended to inform, teach, demonstrate, and develop practical skills. They do not guarantee:

• employment;
• promotion;
• certification;
• academic credit;
• professional licensure;
• business revenue;
• investor funding;
• admission to a school or program; or
• any particular career or financial outcome.

Educational content may become outdated as technology, law, industry practices, and AI systems evolve.

9. User Content

“User Content” means prompts, text, files, images, documents, data, recordings, instructions, feedback, communications, and other material you submit, upload, transmit, or otherwise provide through a Service.

You retain your ownership rights in User Content to the extent you have such rights.

You represent and warrant that:

• you have the rights, permissions, and authority necessary to provide the User Content;
• your submission and our authorized processing of the User Content will not violate law or third-party rights; and
• you will not knowingly submit information you are prohibited from disclosing.

You grant Freedom Forge AI a limited, non-exclusive, worldwide license to host, copy, process, transmit, display, transform, and otherwise use User Content only as reasonably necessary to provide, secure, support, maintain, and improve the applicable Service, comply with law, and exercise rights described in these Terms and our Privacy Policy.

This license does not transfer ownership of your User Content to Freedom Forge AI.

10. Confidential and Sensitive Information

Do not submit confidential, proprietary, regulated, or sensitive information to a general-purpose contact form, demonstration, public-facing feature, or other location not specifically designed to receive such information.

Where a Service is specifically designed to process sensitive or confidential information, additional contractual, technical, privacy, or security terms may apply.

If you use a Service on behalf of an organization, you are responsible for complying with your organization’s confidentiality, records-management, security, and data-governance requirements.

11. Freedom Forge AI Intellectual Property

The Services and all associated technology, software, interfaces, workflows, designs, documentation, branding, logos, trademarks, service marks, content, training materials, methodologies, templates, prompts, processes, graphics, audiovisual materials, and other materials owned or licensed by Freedom Forge AI are protected by intellectual property and other laws.

Except for rights expressly granted in these Terms or a separate written agreement, Freedom Forge AI and its licensors reserve all rights, title, and interest in and to the Services and Freedom Forge AI materials.

You may not copy, modify, distribute, sell, license, publish, publicly display, create derivative works from, or commercially exploit Freedom Forge AI proprietary materials except as expressly authorized.

12. AI-Generated Output and Intellectual Property

Rights in AI-generated output may vary based on:

• applicable law;
• the nature of the output;
• the source material involved;
• third-party model terms;
• your prompts and User Content; and
• whether protectable human authorship or other rights exist.

Freedom Forge AI does not guarantee that AI-generated output is eligible for copyright, trademark, patent, trade-secret, or other intellectual-property protection.

Freedom Forge AI also does not guarantee that output will be unique or that similar output will not be produced for other users.

You are responsible for evaluating whether output is appropriate for publication, commercialization, registration, licensing, or other use.

13. Feedback

If you voluntarily provide suggestions, ideas, recommendations, feature requests, or other feedback about the Services, you grant Freedom Forge AI a perpetual, irrevocable, worldwide, royalty-free right to use that feedback for any lawful purpose without restriction or compensation, provided that this provision does not grant Freedom Forge AI ownership of confidential User Content merely because it is included in a support communication.

14. Third-Party Services and Integrations

Services may link to, integrate with, depend on, or interoperate with third-party websites, software, platforms, APIs, models, payment processors, communications providers, cloud providers, or other services.

Freedom Forge AI does not control third-party services and is not responsible for their:

• availability;
• security;
• content;
• functionality;
• pricing;
• data practices;
• terms;
• changes;
• outages; or
• independent conduct.

Your use of third-party services may be governed by separate agreements with those providers.

A change, restriction, outage, or discontinuation by a third party may affect a Freedom Forge AI Service.

15. Beta, Pilot, Preview, and Experimental Services

Freedom Forge AI may offer beta, pilot, preview, prototype, demonstration, early-access, or experimental Services.

Such Services may:

• contain errors or incomplete features;
• change substantially;
• experience interruptions;
• lose or alter data;
• be withdrawn without general release;
• have limited support; and
• be subject to additional terms.

Unless otherwise stated in writing, beta and experimental Services are provided for evaluation and feedback and should not be relied upon for safety-critical, mission-critical, or legally consequential activities.

16. Fees, Payments, and Taxes

Some Services require payment.

Prices, payment schedules, subscription terms, deposits, retainers, minimum commitments, usage charges, and other commercial terms will be disclosed at purchase, enrollment, or in the applicable order form, proposal, statement of work, or agreement.

You agree to pay amounts properly charged for Services you purchase.

Unless otherwise stated:

• prices are stated in U.S. dollars;
• you are responsible for applicable taxes, duties, or governmental charges other than taxes imposed on Freedom Forge AI’s net income; and
• payment-processing services may be provided by third parties.

Freedom Forge AI may suspend paid Services for materially overdue amounts after providing any notice required by an applicable agreement or law.

17. Subscriptions and Automatic Renewal

Certain Services may be offered on a recurring subscription basis.

Where a subscription automatically renews, the applicable checkout, order form, or enrollment process will disclose material renewal terms, including frequency and price or the method by which price is determined, as required by applicable law.

By enrolling in an automatically renewing subscription, you authorize recurring charges in accordance with the disclosed terms until you cancel.

Cancellation instructions will be provided through the applicable account, checkout, order confirmation, product terms, or customer-support process.

Changes to subscription pricing or material renewal terms will be communicated as required by law or contract.

18. Cancellations, Refunds, and Credits

Cancellation, refund, and credit policies vary by product and service.

The policy applicable to your purchase will be disclosed at purchase, enrollment, or in the applicable agreement.

Unless expressly stated otherwise, there is no universal Freedom Forge AI refund policy that overrides product-specific or contract-specific terms.

Nothing in these Terms limits any non-waivable cancellation, refund, rescission, chargeback, or consumer right provided by applicable law.

19. Promotions, Trials, and Offers

Promotions, free trials, discounts, credits, referral programs, beta access, or special offers may be subject to additional eligibility requirements, expiration dates, restrictions, and terms.

Freedom Forge AI may modify or terminate promotional programs to the extent permitted by applicable law and the applicable offer terms.

20. Communications

By providing contact information, you authorize Freedom Forge AI to send communications reasonably related to your inquiry, account, purchase, enrollment, relationship, or requested Service.

Marketing communications will be sent in accordance with applicable law and applicable consent requirements.

Email marketing may be unsubscribed from using the mechanism provided in the message.

For text messages, message frequency may vary and message and data rates may apply. Where supported, recipients may reply STOP to opt out and HELP for assistance.

Consent to receive marketing text messages is not a condition of purchasing goods or services unless expressly permitted by law.

Freedom Forge AI will honor legally valid revocation and opt-out requests as required by applicable law.

20A. SMS and Text Messaging Terms

The following terms apply to the Freedom Forge AI SMS Program.

Program Description and Messaging Use Cases

Based on the specific consent you provide, Freedom Forge AI may send recurring informational, transactional, customer-service, appointment, scheduling, account, product, platform, utility, beta, early-access, educational, event, and promotional or marketing text messages regarding Freedom Forge AI and its products and services, including LifeHouse OS, The Internal Brain (TIB), consulting, education, utilities, and future offerings.

Opt-Out Instructions

You may opt out of SMS messages at any time by replying STOP. After you send STOP, you may receive one final confirmation message confirming that you have been unsubscribed. You may reply HELP for assistance.

Message Frequency and Message/Data Rates

Message frequency varies. Message and data rates may apply. Your wireless carrier’s standard messaging and data charges may apply to messages sent or received.

Carrier Liability Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and network provider. Freedom Forge AI cannot guarantee that every message will be delivered.

Age Restriction

The Freedom Forge AI SMS Program is intended for individuals 18 years of age or older. If you are under 18, you may not enroll in the SMS Program without appropriate authorization from a parent or legal guardian where permitted by applicable law.

Consent

Consent to receive marketing text messages is not a condition of purchasing goods or services.

21. Privacy

By using the Services, you acknowledge that you have been provided access to the Privacy Policy.

22. Security

Freedom Forge AI uses reasonable administrative, technical, and organizational safeguards designed to protect the Services and information appropriate to the nature and sensitivity of the information processed.

No security program can guarantee absolute security.

You are responsible for:

• using appropriate passwords and authentication controls;
• protecting account credentials;
• maintaining secure devices and networks;
• applying appropriate access controls within your organization;
• promptly reporting suspected compromise; and
• following security instructions applicable to the Service.

Freedom Forge AI may take actions reasonably necessary to address actual or suspected security threats, including restricting access, requiring credential resets, or temporarily suspending functionality.

23. Availability, Maintenance, and Changes

Freedom Forge AI may update, modify, replace, suspend, or discontinue features or Services.

We may perform scheduled or emergency maintenance.

We do not guarantee that every Service will be available at all times or that access will be uninterrupted, error-free, or free from delays.

Where a separate paid agreement includes service levels or continuity commitments, that agreement controls.

24. Electronic Communications and Signatures

You agree that electronic communications, notices, disclosures, agreements, and records may satisfy legal requirements that such communications be in writing to the extent permitted by law.

Where you electronically accept terms, submit an order, check a consent box, sign electronically, or otherwise indicate agreement through an electronic process, you agree that your electronic action may serve as your signature to the extent permitted by law.

You are responsible for maintaining a valid email address and other contact information where required for notices relating to your account or Services.

25. Copyright and Intellectual Property Complaints

If you believe material available through a Freedom Forge AI Service infringes your copyright or other intellectual-property rights, contact:

Your notice should identify:

• the protected work or right;
• the allegedly infringing material;
• the location of the material;
• your contact information;
• the basis for your claim; and
• any other information reasonably necessary to evaluate the request.

Freedom Forge AI may remove or restrict material when appropriate and may request additional information.

26. No Professional Advice

Unless expressly stated in a signed agreement with a properly qualified professional, the Services do not constitute legal, medical, tax, accounting, investment, financial, insurance, clinical, or other regulated professional advice.

AI-generated information, educational materials, templates, examples, and consulting observations should not be treated as a substitute for advice from a qualified professional where professional advice is appropriate.

27. No Guarantee of Results

Freedom Forge AI does not guarantee that use of the Services will result in:

• increased revenue or profit;
• reduced expenses;
• successful fundraising;
• improved search rankings;
• customer acquisition;
• regulatory compliance;
• employment;
• academic success;
• productivity improvements;
• business transformation;
• error-free automation;
• uninterrupted operations; or
• any other specific result.

Examples, case studies, projections, estimates, demonstrations, testimonials, and illustrations are not guarantees of future performance.

28. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN AGREEMENT SIGNED BY FREEDOM FORGE AI, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

FREEDOM FORGE AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

FREEDOM FORGE AI DOES NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
• DEFECTS WILL BE CORRECTED;
• AI OUTPUT WILL BE ACCURATE, COMPLETE, UNIQUE, OR RELIABLE;
• THE SERVICES WILL MEET EVERY USER’S REQUIREMENTS; OR
• THIRD-PARTY SERVICES WILL REMAIN AVAILABLE OR UNCHANGED.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

29. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM FORGE AI LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM FORGE AI’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO FREEDOM FORGE AI FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY; OR
2. ONE HUNDRED U.S. DOLLARS (US $100) IF YOU PAID NOTHING FOR THAT SERVICE.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

A SEPARATE SIGNED AGREEMENT MAY PROVIDE DIFFERENT LIABILITY TERMS, IN WHICH CASE THAT AGREEMENT CONTROLS FOR THE APPLICABLE ENGAGEMENT.

30. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Freedom Forge AI LLC and its members, managers, officers, employees, contractors, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of or related to:

• your unlawful or unauthorized use of the Services;
• your material violation of these Terms;
• your User Content;
• your infringement or violation of third-party rights; or
• your fraud, willful misconduct, or unlawful conduct.

This section does not require a consumer to indemnify Freedom Forge AI for claims arising solely from Freedom Forge AI’s own conduct where such indemnification would be prohibited by law.

31. Suspension and Termination

You may stop using the Services at any time, subject to applicable payment, subscription, cancellation, and contractual obligations.

Freedom Forge AI may suspend or terminate access if we reasonably determine that:

• you materially violated these Terms;
• your use creates a security, legal, technical, or fraud risk;
• payment is materially overdue;
• continued access could harm another person or the Services;
• required by law or governmental order; or
• the applicable Service is discontinued.

Where reasonably appropriate and legally required, we may provide notice and an opportunity to cure before termination.

Termination does not eliminate obligations that accrued before termination.

Sections that by their nature should survive termination will survive, including provisions regarding intellectual property, fees owed, disclaimers, limitation of liability, indemnification, dispute resolution, and other accrued rights.

32. Changes to These Terms

Freedom Forge AI may update these Terms as Services, laws, technology, or business practices change.

We will update the “Last Updated” date when revisions are made.

Where required by law, contract, or the nature of a material change, we will provide additional notice or obtain renewed agreement.

Freedom Forge AI will not rely on undisclosed retroactive changes to obtain rights to customer content or personal information that would require additional notice or consent under applicable law.

Your continued use of a Service after legally effective updated Terms may constitute acceptance where permitted by law.

33. Dispute Resolution and Informal Resolution

Before filing a lawsuit arising out of these Terms or the Services, you and Freedom Forge AI agree to make a good-faith effort to resolve the dispute informally, except where immediate injunctive or emergency relief is reasonably necessary.

A party seeking informal resolution should provide written notice describing:

• the party’s name and contact information;
• the relevant Service;
• the facts giving rise to the dispute;
• the relief requested; and
• supporting information reasonably necessary to understand the claim.

The parties will have 30 days after receipt of a sufficiently detailed notice to attempt informal resolution before filing suit, unless a different period is required by law or agreed in writing.

Nothing in this section prevents either party from seeking emergency injunctive relief or pursuing a claim in small claims court where eligible.

34. Governing Law and Venue

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except to the extent federal law or another non-waivable law applies.

Unless a separate signed agreement provides otherwise, any judicial proceeding arising out of or relating to these Terms or the Services that is not eligible for small claims court will be brought in a state or federal court having jurisdiction in or serving Fairfield County, Connecticut.

You and Freedom Forge AI consent to personal jurisdiction and venue in those courts to the extent permitted by law.

Nothing in these Terms deprives a consumer of protections or rights that cannot lawfully be waived under the law of the consumer’s residence.

35. Force Majeure

Freedom Forge AI will not be responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil disturbance, labor disruption, governmental action, utility failure, telecommunications failure, internet disruption, cyberattack, third-party platform outage, cloud-provider failure, AI-provider outage, or other similar events, except to the extent such limitation is prohibited by law or a signed agreement provides otherwise.

36. Assignment

You may not assign or transfer these Terms or rights under them without Freedom Forge AI’s prior written consent, except where applicable law provides otherwise.

Freedom Forge AI may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, financing, or transfer of the applicable business or Service, subject to applicable law.

37. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be enforced to the maximum extent permitted or, if necessary, severed, and the remaining provisions will remain in effect.

38. Waiver

Failure to enforce a provision of these Terms is not a waiver of the right to enforce that provision or another provision later.

A waiver is effective only if made in writing by an authorized representative of Freedom Forge AI.

39. Entire Agreement

These Terms, together with the Privacy Policy and any applicable supplemental terms, order forms, statements of work, or signed agreements, constitute the agreement governing your use of the applicable Services.

A signed written agreement controls over these Terms to the extent of a direct conflict concerning the same subject matter.

40. Interpretation

Headings are for convenience only and do not limit interpretation.

The words “including” and “includes” mean “including without limitation.”

References to “writing” include legally valid electronic communications where permitted.

Nothing in these Terms will be interpreted against a party solely because that party drafted the provision.
